Terms of Service

These Terms of Service ("Terms") govern your access to and use of cleverpocketscoutshelvs.lol (the "Site"), operated by Pocket Scout Media Ltd, a company incorporated in England and Wales with company number 14872051 and registered office at 27 Marylebone Lane, Suite 4, London W1U 2NL. By accessing the Site you agree to be bound by these Terms in full. If you do not accept them, you must stop using the Site.

1. Nature of the service

The Site is an independent editorial publication about five historic luxury hotels in London. We are a publisher, not a travel agent, tour operator, booking platform or intermediary. We do not take reservations, hold deposits, issue confirmations or act as agent for any hotel. Any contract for accommodation, dining or other services is formed exclusively between you and the relevant hotel or its authorised booking channel, on that party's own terms.

Rates, room counts, opening hours, menus, restaurant tenancies, Michelin ratings and dress codes described on the Site are researched in good faith and are indicative only. They change frequently and without notice. You must verify all material facts directly with the hotel before making any booking decision or incurring any expense.

2. User obligations

In using the Site you agree that you will:

  • use it only for lawful, personal, non-commercial purposes;
  • not attempt to gain unauthorised access to any part of the Site, its servers, or any connected system or network;
  • not introduce any virus, trojan, worm, logic bomb, keystroke logger or other material that is malicious or technologically harmful;
  • not conduct any denial-of-service or distributed denial-of-service attack;
  • not scrape, crawl, harvest, mirror or systematically extract content, whether by automated means or otherwise, except by a search engine bot obeying our robots directives;
  • not use the Site's content to train, fine-tune or evaluate any machine-learning or generative model without our prior written permission;
  • not misrepresent your identity, impersonate any person, or submit false corrections or vexatious enquiries;
  • not use the contact form to transmit unsolicited commercial communications, defamatory material, or content that infringes the rights of any third party.

Breach of this section may constitute a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and will co-operate with them by disclosing your identity where lawfully required.

3. Intellectual property rights

All editorial text, structure, selection, arrangement, layout, graphics, iconography, stylesheets and source code on the Site are owned by or licensed to Pocket Scout Media Ltd and are protected by copyright, database right and, where applicable, trade mark law. All rights not expressly granted are reserved.

You may view, download to a local cache, and print individual pages for your own personal, non-commercial reference. You may quote up to two hundred words from any single page provided you attribute the quotation to cleverpocketscoutshelvs.lol and include a working hyperlink to the source page. You may not republish, redistribute, sell, license, adapt, or create derivative works from our content, nor remove any copyright or proprietary notice.

Photographs displayed on the Site are licensed from third-party photographic libraries and remain the property of their respective creators. No licence to reuse those images is granted to you by us.

Hotel names, logos and marks — including The Savoy, The Ritz London, Claridge's, The Connaught and The Dorchester — are the trade marks of their respective owners and are used here purely descriptively for the purposes of reporting, criticism and review. No affiliation, endorsement or sponsorship is claimed or implied.

4. Third-party links

The Site contains hyperlinks to hotel websites, restaurant reservation pages, museums and public bodies. We provide these for convenience and reader verification only. We do not control, monitor, endorse or assume responsibility for the content, accuracy, availability, security or privacy practices of any external site. Following an external link is entirely at your own risk and subject to that site's own terms.

5. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, conditions and representations, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, accuracy or non-infringement.

We make no warranty that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that content is current. Editorial opinions are the honestly held views of our writers at the time of publication and are not statements of fact.

6. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under the laws of England and Wales.

Subject to the paragraph above, and to the fullest extent permitted by law:

  • we shall not be liable for any indirect, special, incidental, punitive or consequential loss;
  • we shall not be liable for loss of profit, revenue, business, goodwill, anticipated savings, data, or for wasted expenditure;
  • we shall not be liable for any loss arising from reliance on rates, availability, opening hours or service descriptions published on the Site;
  • we shall not be liable for any act, omission, cancellation, overbooking, service failure or injury attributable to any hotel, restaurant, bar, spa or transport provider mentioned on the Site;
  • our total aggregate liability in contract, tort (including negligence), breach of statutory duty or otherwise arising in connection with the Site shall not exceed one hundred pounds sterling (£100).

If you are a consumer, these Terms do not affect your statutory rights under the Consumer Rights Act 2015 or equivalent legislation in your jurisdiction.

7. Indemnity

You agree to indemnify and hold harmless Pocket Scout Media Ltd, its directors, employees and contractors against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Site.

8. Suspension and termination

We may suspend, restrict or terminate your access to the Site immediately and without notice if we reasonably believe you have breached these Terms, if your use imposes a disproportionate load on our infrastructure, or if we are required to do so by law or by a competent authority. We may also withdraw, amend or discontinue the Site or any part of it at any time without liability. Sections 3, 5, 6, 7, 9 and 10 survive termination.

9. Changes to these Terms

We may revise these Terms at any time by publishing an updated version on this page with a new effective date. Your continued use of the Site after publication constitutes acceptance of the revised Terms. We recommend reviewing this page periodically. Where a revision materially reduces your rights, we will display a notice on the Site homepage for at least thirty days.

10. Governing law and dispute resolution

These Terms, their subject matter and their formation (including any non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.

Before commencing formal proceedings, we ask that you contact us at [email protected] setting out the nature of the dispute. We undertake to respond substantively within twenty-one days and to attempt good-faith resolution. Where a dispute is not resolved within sixty days, the parties may agree to refer it to mediation under the CEDR Model Mediation Procedure before litigation.

Subject to the above, the courts of England and Wales shall have exclusive jurisdiction. If you are a consumer resident in the European Economic Area, you retain the right to bring proceedings in the courts of your country of residence and to benefit from the mandatory consumer protection provisions of that country's law.

11. General provisions

  • Severability: if any provision is held unlawful or unenforceable, the remaining provisions continue in full force.
  • No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
  • Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site.
  • Third-party rights: no person other than the parties has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.
  • Force majeure: we are not liable for any failure or delay caused by events outside our reasonable control.
